Article 1. Parties and applicability
1.1 A) Optics-World B.V. is a supplier specializing in the supply of optical products, such as riflescopes, night vision goggles etc. Optics-World B.V. is in this set of general conditions referred to by its full name or abbreviated as "Supplier".

B) The other party of Optics-World B.V. is referred to in these general conditions as the "Buyer".

C) In these general conditions, "Products" means all that Optics-World B.V. offers on its website.

1.2 The general conditions are applicable to all agreements you conclude with Optics-World B.V. and all products you purchase from it. 
1.3 The general conditions can only be deviated from in writing.
1.4 With every order you place, you accept the applicability of this set of general conditions.
 

Article 2. Realization (and termination) of the agreement
2.1 An agreement is established when Optics-World B.V. has sent an order confirmation or invoice by e-mail to the e-mail address provided by the customer. It is irrelevant whether the order is placed via the website, by email or by phone. When placing an order, the Customer declares that it is not on a sanctions list, on the basis of which it is prohibited to supply certain products to you. 
2.2 The Customer may cancel its order within 24 hours of its placement free of charge by sending an email to info@Optics-World.nl.

2.3 When Optics-World B.V. has ordered a product that is specially intended and tailored to the Buyer's requirements, the order cannot be cancelled and/or the product cannot be returned.

2.4 There is no right of withdrawal or statutory cooling-off period for business purchases (B2B), i.e. purchases made while the Customer is acting in the course of its business.

2.5 Return costs are at your own expense at all times and returns are at your own risk.

Article 3. Prices, products, offers
3.1 All prices on the website of Optics-World B.V. are in euro's and including VAT, and excluding disposal fee and shipping costs, unless otherwise stated on the website. Printing and typing errors are reserved.
3.2 Products (and special offers) are available (valid) while supplies last.
3.3 Products are delivered under retention of title. This means that the Products remain the property of Optics-World B.V. until full payment for the Product has been received.

3.4 Under various applicable laws and regulations, Optics-World B.V. may not supply every product to every company/person. There are several products that Optics-World B.V. may only supply to (local) governments. Optics-World B.V. makes every effort to clearly indicate on the website which products are free to supply to anyone. However, Optics-World B.V. does reserve all rights. This means among other things that if after an order has been placed it appears that the product cannot be delivered due to regulations, Optics-World B.V. has the right to cancel the order at any time without any form of compensation to the customer.

3.5 The lowest price guarantee (in accordance with the banner on the product pages) applies exclusively to the Swarovski Optik and Kahles brands. The lowest price guarantee does not apply if the lower price is offered by a party that is not an official authorized dealer within Europe of the Swarovski Optik/Kahles brands. In addition, the lowest price guarantee does not apply if it is not an Identical product. Identical means that the manufacturer, type designation and other characteristics etc. are identical. When a price of Optics-World B.V. is compared with that of another party, the Buyer must be able to prove that it concerns an offer in the same period in which Optics-World B.V. offers its product and the price of that other party must have been valid for at least 24 hours or more (no "flash deals").

Article 4. payment
4.1 Orders through Optics-World B.V. can be paid in the following way: by bank (IDEAL, Mollie, or any other online payment service) (at the listed rates etc) Optics-World B.V. does not accept cash payments.

4.2 Shipping costs shall be borne by the Customer, these are: - delivery by DPD and DHL at the then current rates, unless other arrangements are made.

4.3 Unless otherwise stipulated, the Customer is obliged to pay the invoices within 30 days of the invoice date without deduction of any discount. Settlement with any claim against the Supplier is excluded. For large orders, payment in advance is usually required; separate arrangements shall be made in this regard.
4.4 If the Buyer fails to pay the invoice amount due on time, it shall owe the Seller interest (compounded) of 1.25% of the invoice amount for each month or part thereof by which the payment term is exceeded.
If at any time the statutory interest pursuant to article 6: 119 a. of the Dutch Civil Code is higher than the interest due under the interest clause contained in this paragraph, the seller shall be entitled to claim the interest pursuant to article 6: 119 a. of the Dutch Civil Code, in which case the interest shall be calculated in the manner indicated in this article of the law.
4.5 Only those payments which have been made in the manner indicated by the seller shall be discharged.
4.6 The Supplier shall be entitled to dissolve all agreements concluded with the Customer if the Customer fails to fulfil the obligation under an agreement concluded with the Supplier, if the Customer is granted a suspension of payments, or if the Customer is declared bankrupt.
4.7 In addition to the amount due, the Supplier shall be entitled to claim from the Buyer all costs caused by the Buyer's non-payment, both judicial and extrajudicial collection costs.

4.8 Seller shall not be obliged to prove that he has fallen into the expenditure of extrajudicial collection costs. If the seller files for the bankruptcy of the buyer, the latter shall be liable for the costs of filing for bankruptcy in addition to the amount owed and the judicial and/or extrajudicial costs imposed thereon. 

Article 5. delivery and delivery time

5.1 Orders will be delivered as soon as possible. Optics-World B.V. strives to deliver the placed order within 7 days (only applicable to stock products), when the product is not in stock and has to be special ordered Optics-World B.V. is depending on the delivery time of the producer and/or her supplier, for products with an export restriction Optics-World B.V. has to apply for an export license at the Customs (CDIU), Optics-World B.V. has no influence on the duration of the issuing of the export license, this can take up to 12 weeks. All delivery times are indicative and only obligates an effort (not the result) to deliver within the specified time frame. Delayed delivery shall in no case confer a right to rescind the contract and/or damages. 
5.2 The risk of damage and/or loss of the Products to be delivered is transferred at the moment the Products are put on transport.

Article 6. Special provisions

6.1 Optics-World B.V. delivers in accordance with Dutch law and supplies products that are permitted in the Netherlands. The Buyer is always responsible for compliance with the laws and regulations in its own country. Optics-World B.V. delivers products that may not be allowed to buy and keep in every country. Optics-World B.V. bears no responsibility for and will not be liable for delivery of Products that are prohibited in the country of order or delivery. If it appears that a Product is prohibited in that country, this will not entitle you to a refund of the purchase price and/or compensation for damages.

6.2 In line with the foregoing, Optics-World B.V. points out that it is prohibited to sell, transfer, rent, deliver, or otherwise dispose of any Products it offers on its website to countries/persons or entities on a sanctions list. For the sanctions list always consult the website of the relevant authorities.

6.3 Optics-World B.V. supplies, among other things, Products manufactured in the United States. When delivering Products from the United States, various obligations/restrictions are usually imposed, for example with respect to resale. Optics-World B.V. is always authorized to resell, based on agreements it has with its suppliers in the United States or importers of Products from the United States. However, you - the Buyer - are prohibited from reselling products manufactured in the United States to countries outside your own country and/or to military units that use the Products for military purposes. By placing the order, the Buyer declares to comply with the rules imposed by the manufacturer of the Products. The Buyer fully indemnifies Optics-World B.V. for any violations of the rules imposed by the manufacturer and its negative consequences.

6.4 You are aware that upon receipt of the product and payment, you are the new owner and must at all times make your own investigation as to whether you may re-export the product in accordance with applicable laws and regulations in your country as well as the country of origin.

Article 7. Warranty and liability
7.1 Optics-World B.V. is never obliged to pay compensation (in whatever form) to the customer unless there is intent or gross negligence on the part of Optics-World B.V..
7.2 If Optics-World B.V. for any reason has to compensate any damage, it will never be higher than the amount paid by its insurance. If no payment is made under the insurance, the liability of Optics-World B.V. is limited to an amount equal to the invoice value of the product supplied.
 

Article 8. Embargoed countries

Optics-World B.V. does not ship products to countries on sanctions lists. These sanctions lists are available on websites of local competent authorities. These are sanction lists of the Netherlands, but also of the country of origin of the product (so where the product is produced). (Re)export or temporary export to countries on a sanctions list is prohibited. In case of suspicion of resupply or export to the mentioned countries Optics-World B.V. will not deliver and has the right to cancel an order free of charge. If a named country places an order, Optics-World B.V. also always has the right to cancel the order without giving any reason.

Article 9. Orders outside Europe.

Optics-World B.V. does not ship thermal imaging/thermal equipment (except thermal rifle scopes, these always require a permit outside the Benelux) outside Europe unless the destination is within the following countries: Australia, Canada, Japan, New Zealand, Norway, Switzerland including Liechtenstein, United States of America and United Kingdom. For these countries we have a permanent export license EU 001 for DUAL-USE goods. However, these goods are always reported through the forwarder to Customs. These goods are shipped exclusively.

Article 10. Goods in accordance with the military goods list.

Optics-World B.V. only delivers goods classified under the military goods list within the Benelux without an export license (license exemption). Outside the Benelux this always requires an export license from the CDIU. For this the end-user must always sign an End-Use Statement. Goods categorized in our assortment are thermal rifle scopes (rifle scopes with image intensification ML1 D.) and night vision (accessories) from GEN 1 (ML15 C.). These are shipped outside the Benelux only upon receipt of an export license from the CDIU. If a rifle scope is specially designed for exclusively military government use, it may be classified under the export regulations as ML1 D. These items are shipped exclusively.

Article 11. Applicable law and competent court

All agreements with Optics-World B.V. are exclusively governed by Dutch law and disputes arising from the agreement shall be settled by the Dutch courts.
